Couple charged for statutory rape, sexual exploitation of minor

MOBILE, AL (KPLR) – A St. Louis couple was arrested in Mobile, Alabama, wanted in connection for allegedly filming a sexual encounter with a minor nearly two years ago, the St. Louis County Police Department said Thursday.

The St. Louis County Prosecuting Attorney’s Office charged Aubrey Costello-Warden with one count of first-degree of statutory rape, two counts of first-degree statutory sodomy, and sexual exploitation of a minor. Her boyfriend, John Ferguson, was charged with one count of sexual exploitation of a minor and two counts of possession of child pornography.

Those charges were filed August 19.

According to Officer Shawn McGuire, a police spokesman, the incident occurred December 18, 2013. Costello-Warden is said to have performed sexual acts—including intercourse—on the child victim while Ferguson recorded the encounter. Ferguson was also said to be in possession of more than 20 images of child pornography.

Costello-Warden and Ferguson were arrested in Mobile, Alabama on September 24. They’re awaiting extradition back to St. Louis County. Costello-Warden will be held on $500,000 cash-only bond, while Ferguson will be jailed on $250,000 cash-only bond.
