MO Supreme Court Overtruns Medical Malpractice Limits

St. Louis, MO (KPLR) The Missouri Supreme Court overturns a medical malpractice damage cap, removing the limit people could win in lawsuits. The 4-3 decision came after the court ruled the 2005 law violated the right to a jury trial by capping noneconomic damages in medical malpractice cases at $350,000. It was a key provision in a Republican-backed “tort reform” law. The lawmakers thought it would help reign in rising medical malpractice premiums for doctors, improving the availability of health care.
