Judge Finds “Choose Life” License Plates Unconstitutional

RALEIGH, NC (KTVI) – A federal judge has ruled that it is unconstitutional to issue pro-life license plates.  U.S. District Court Judge James C. Fox ruled that unless the state produced similar plates supporting abortion rights then the pro-life plates cannot be issued.

The ACLU of North Carolina has filed a lawsuit with the U.S. District Court to seek a specialty license plate that supports a woman’s right to reproductive freedom.  They say the government cannot create a platform to express a political view without a method of expressing the opposite viewpoint.

Officials say the legislature repeatedly refused to authorize a plate that supported abortion rights.

In Nov. 2011 Judge Fox temporarily blocked production of the “Choose Life” plate.  Now, that injunction is permanent.  House Bill 289, authorized the production of a “Choose Life” license plate in the 2011 North Carolina legislative session.
